Terms & Conditions

Payment & Reservations

 

Reservations are accepted and confirmed upon receipt of Trip Deposit (or Service Fee) per traveler, payable by check in US Dollars, money order, cashiers check, or Moon Clerk (the online payment portal used on each trip page), along with a completed Registration Form. Final Payment is due according to each trip's payment plan schedule. 

Responsibility & Risk​

As a fully aware traveler and registrant to AfroBuenaventura Transformative Travel (the Company) programs (the Activity), you (the Client) will be required to sign a notarized Release of Liability which states that the Client release from liability and waive the Client's right to sue the Company, their employees, officers, volunteers and agents from any and all claims, including claims of the Company’s negligence, resulting in any physical injury, illness (including death) or economic loss the Client may suffer or which may result from the Client's participation in the Activity, travel to and from the Activity (including air travel), or any events incidental to this Activity.

Expenses Not Included

  • Airfares: International/Domestic

  • Meals not noted in itinerary

  • Transportation to unscheduled activities

  • Laundry, or other personal items

  • Travel Insurance (required of all registrants)

  • Medical Expenses

  • Airport Departure Taxes

  • Passport Application Fee

  • Costs associated with trip interruption or modification due to weather, travel conditions, political/civil disputes, medical emergencies or other causes beyond our control. Choose a travel insurance that provides coverage for these rare cases.

Expenses Included

  • Airport Transfers, if arrivals/departures are according to itinerary

  • Double occupancy accommodations, according to trip duration, or according to service agreement

  • Local Tour Guides and ground transportation to scheduled activities

  • Entry fees to Museums, Parks, according to planned itinerary

  • All Breakfasts

  • Meals, according to itinerary

  • Other fees according to itinerary

  • Additional services as stated in service contract

Cancelation Policy
Non-refundable Fees

All service fees, including upfront and fees for services to be rendered, are non-refundable.

Refundable Fees

Refundable payments to third-parties for services not rendered or goods not acquired will be eligible for refund minus any transaction fees.

Cancellations for Third-Party Goods & Services

Cancellation for any third-party services (hotels, transportation) will be governed by their respective policies. AfroBuenaventura is not responsible for any cancellations by third-party providers.

Rescheduling and Transfers

Fees for AfroBuenaventura services not rendered are transferable within 365 days from original payment. The client will be responsible for price differences resulting from rescheduling.

Refund Policy

The client is eligible for a full refund if notice of cancellation is received in writing at least 180 days in advance, 50% refund if notice received more (or equal to) 90 days, and no refund if notice received less than 90 days before the service.

 

Should an engagement be canceled by AfroBuenaventura at any time, payments will be fully refunded minus any transaction fees.

Force Majeure

This clause governs the handling of a conflict that arises due to an event occuring with or without human intervention, not reasonably been foreseen by the involved parties, beyond the parties' control, and they could not have prevented its consequences; such as natural disasters (earthquakes, floods, hurricanes), acts of government (war, terrorism, embargoes), pandemics, labor strikes, or other events beyond the control of the parties. This list is non-exhaustive.

Notification Requirement

The affected party must notify the other party in writing within 2-5 days after the occurrence of the Force Majeure event, outlining the nature of the event and its impact on the performance or the service or event.

Impact on Obligations

Performance of obligations are suspended during the duration of the Force Majeure event; and the suspension will last until conditions are conducive for activities to resume, and in accordance with guidance by relevant local or national authority.

Mitigation Efforts

The affected party must take reasonable steps to mitigate the effects of the Force Majeure event and to resume performance as soon as possible. Reasonable steps may include providing forecasting that might help in decision making, adjusting plans to decrease the impact of the event, and communicating with the affected parties. This list is not exhaustive.

Termination Rights

EIther party has rights to terminate the agreement if the Force Majeure event continues for more than 14 days or is forecasted to overlap with the date of service.

Exclusions

Events or circumstances that do not qualify as Force Majeure, include  economic hardship or general market conditions, and weather and environmental conditions that do not pose threat to life or limb.

No Liability for Delay

Neither party shall be liable for any delays or failure to perform their obligations due to a Force Majeure event.

 
Governing Law

This agreement shall be governed by the laws of the State of Georgia.

Changes to the Cancelation Policy

AfroBuenaventura reserves the right to make adjustments to the Cancelation policy and communicate any changes to clients promptly.
